The petitioner is the wife, who has filed HMOP No.548 of 2024 before the Sub Court, Ambattur. The respondent/husband has filed HMOP No.101 of 2025 for restitution of conjugal rights on the file of Principal Sub Court, Mayiladuthurai. The petitioner’s divorce application is earlier in point of time and necessarily, both HMOP No.548 of 2024 and HMOP No.101 of 2025 have to be tried together to avoid conflicting orders as well as multiplicity of proceedings. 3. In the light of the above, Tr.C.M.P.No.869 of 2025 is allowed and HMOP No.101 of 2025 is withdrawn from the file of Principal Sub Court, Mayiladuthurai and transferred to the file of Sub Court, Ambattur to be jointed tried along with HMOP No.548 of 2024. 4. The Principal Sub Court, Mayiladuthurai is directed to send the entire 2/4 https://www.mhc.tn.gov.in/judis TR CMP No. 869 of 2025 records relating to HMOP No.101 of 2025 to Sub Court, Ambattur forthwith.
