ORAL ORDER Petitioners are seeking to quash the complaint/FIR in Crime No.64/2025 registered at Javagal Police Station, Hassan for the offence punishable under Section 126(2), 189(2), 190, 351(2), and 352 of BNS, 2023. 2. FIR is registered on the basis of a complaint lodged by respondent No.2 against accused Nos.1 to 4 in respect of an incident alleged to have taken place on 05.06.2025 between 11.30 – 12.00 noon. 3. As per complaint averments, when cleaning work in the land bearing Survey No.498 of Neelagiri Kavalu Village was going on, the accused came in two vehicles, picked up quarrel with the complainant, wrongfully restrained and abused her stating that her husband owes some money to them and threatened her with dire consequences saying that they will kill her and her son by pouring kerosene and setting fire etc. 4. A memorandum of compromise petition is filed under Section 359 r/w Section 528 of BNSS, 2023, by the

learned counsels appearing for petitioners and respondent No.2. The said application is accompanied by a joint affidavit, signed by the petitioners as well as respondent No.2/defacto complainant. 5. It is stated that a suit in O.S.No.205/2025 was filed by petitioner No.1 before the Civil Court, Arasikere, seeking recovery of Rs.10,00,000/- with interest, and the said suit has been settled between the parties, in terms of the compromise memo. Post settlement, respondent No.2 has now voluntarily come forward, willing to compound the criminal case filed against the petitioners. 6. Petitioner Nos.1 to 4 as well as respondent No.2 are present before the Court. They stated that the matter has been settled. Respondent No.2/defacto complainant submits that in view of the settlement, she is not interested in pursuing the matter any further and she has no objection to quash the proceedings. 7. Material on record reveals that the incident is on account of a civil dispute between the parties. The suit filed by petitioner No.1 has been disposed of in view of the settlement. - 5 -

The parties have filed a joint affidavit reporting settlement before this Court. The dispute is purely private in nature arising out of a civil dispute.
Since the parties have resolved all the disputes and respondent No.2 having submitted that she is not interested in pursuing the matter and she has no objection to quash the proceedings, no useful purpose will be served in continuing the proceedings pending against the petitioners. Hence, the following:
ORDER I.A.No.2/2025 is allowed. Consequently, the petition is allowed. The entire proceedings arising out of FIR in Crime No. 64/2025 registered at Javagal Police Station, Hassan are quashed.
