1. Mr. Lalit Sharma and Ms. Suraiya Naaz, learned counsel for the applicant.
2. Mr. Pankaj Joshi, learned Assistant Government Advocate the State.
3. Present applicants namely ‘Nathuni Sahni, son of Shri Jaddu and Smt. Geeta, wife of Shri Nathuni Sahni,’ are praying for regular bail in relation to First Information Report dated 19.05.2025 bearing FIR No. 0233 of 2025, Police Station – Rudrapur, District – Udham Singh Nagar, wherein present applicants along with two others Govind Sahni and Jitendra Sahni have been implicated for the offence punishable under Section 80 of BNS, 2023.

Learned counsel for the applicants submits that both the applicants are senior citizen, aged about 77 years and 65 years and their son has also been implicated with them for the offence punishable under Section 80, 238 BNS, 2023. He further submits that deceased committed suicide by hanging on 27.04.2025 and family members of the deceased also joined the last ceremonies of cremation. He further submits that after 22 days of her death, the FIR has been lodged and the applicants’ son has also been arrested with them. He further submits that applicants are aged persons and their son is already in custody though investigation is going on but it cannot be ruled out that if deceased committed suicide their son is responsible for this and they are not responsible for suicide of the deceased (daughter-in-law) and they are languishing in jail since 28.06.2025. 5. On the previous date, State was directed to get instructions. Today, Mr. Pankaj Joshi, learned AGA for the State, on instructions submits that there is ligature marks on the cheek of the deceased and investigation is still going on. He further submits that there is a delay of 22 days in filing of the FIR and since, it was unnatural death by hanging no complaint was lodged by the husband of the deceased, which shows about the conduct of the husband of the deceased and this is the reason, after 22 days in compelling circumstances family members of the deceased lodged the FIR. He further submits that investigation is still going on and
2025:UHC:6691 both the applicants are aged persons and their son (husband) is already in custody, therefore, considering their age factor, applicants may be enlarged on bail. 6. After hearing the learned counsel for the parties and taking into consideration the fact that applicants are aged persons and their son is already in jail, therefore, this Court is of the view that applicant deserves for bail but some stringent condition should be imposed on them. 7. Accordingly, without expressing any opinion on the merit of the case, the bail application is allowed. 8. Let the applicants ‘Nathuni Sahni, son of Shri Jaddu and Smt. Geeta, wife of Shri Nathuni Sahni,’ be released on bail on furnishing their personal bond and two sureties each of the like amount to the satisfaction of the court concerned. 9.
After being released on bail, both the applicants shall give their full cooperation with the ongoing investigation and will not make an attempt to influence the investigation. 10. It is also made clear that this order will not be treated as precedent in respect of other co accused. (Rakesh Thapliyal, J.)
