GP FOR CIVIL SUPPLIES The Court made the following ORDER: The present writ petition is filed questioning the proceedings issued by the 3rd respondent vide Rc.DT (LR) 1585/2024, dated 22.01.2025, in suspending the authorization of the petitioner’s fair price shop No.1318015 of Basthipadu Village, Kallur Mandal, Kurnool District as illegal and arbitrary. 2. Heard both sides. 2 JS,J W.P.No.5341/2025 3. The 3rd respondent vide proceedings in Lr.No.B/568/2012, dated 13.02.2013 appointed the petitioner as fair price shop dealer on permanent basis. The petitioner was allotted fair price shop No.1318015 of Basthipadu Village, Kallur Mandal, Kurnool District. 4. The petitioner was served with show cause notice dated 06.01.2025, calling for his explanation, and the petitioner in pursuance to the said notice submitted explanation on 18.01.2025. Without considering the explanation, the impugned proceedings are issued suspending the authorization of the petitioner’s fair price shop. Aggrieved by the same, the present writ petition is filed. 5. Learned counsel for the petitioner submits that, enquiry was conducted in his absence and the alleged Panchanama is prepared at the instance of political pressure. Learned counsel further submits that the petitioner has preferred a statutory appeal before the 2nd respondent along with stay application on 25.01.2025, and till today, no orders are passed on the stay petition and the same is pending before the authority for consideration. 6. In view of the facts and circumstances of the case, the Writ Petition is disposed of, directing the 2nd respondent to consider and pass appropriate orders on the stay application as well as the appeal filed by the petitioner on 25.01.2025, within a period of two 3 JS,J W.P.No.5341/2025 (02) weeks from the date of receipt of a copy of this order. Till such time, the respondents are directed not to appoint any third party in respect to the petitioner’s fair price shop No.1318015 of Basthipadu Village, Kallur Mandal, Kurnool District. No order as to costs.
