HIGH COURT OF JUDICATURE AT ALLAHABAD CRIMINAL MISC. WRIT PETITION No. - 19544 of 2025 Court No. - 48 HON'BLE CHANDRA DHARI SINGH, J. HON'BLE LAKSHMI KANT SHUKLA, J. 1. The instant petition has been filed by the petitioner seeking to quash the impugned First Information Report dated 09.05.2025, giving rise to Case Crime No. 249 of 2025, under Sections 316(2), 318(4), 338, 336(3), 340(2), 61(2), 351(2), 3(5) of B.N.S., Police Station Chhata, District Mathura. 2. Learned counsel appearing on behalf of the petitioner submitted that the impugned FIR, which has been lodged by respondent no. 4, is an abuse of process of law. He submits that the petitioner is an innocent person and has been falsely implicated in the present case. The petitioner is only a marginal witness of the sale deed. He has not committed any offence as alleged in the impugned FIR which has been lodged with mala fide intention and, therefore, it may be quashed. 3. At this juncture, Mr. S.K. Ojha, learned A.G.A. appearing on behalf of the State informs the Court that investigation has already been completed and a charge sheet has also been filed. It is further submitted that it is the well settled law that the writ jurisdiction is an extraordinary jurisdiction of the Court and while exercising this jurisdiction the Writ Court interfere with the quashing of the FIR or with the investigation only in the rarest of the rare matters. 4. Learned A.G.A. appearing on behalf of the State further submits that since the charge-sheet has been filed and nothing has been reported against the petitioner and he has already been exonerated by the Versus Counsel for Petitioner(s) : Somendra Singh Counsel for Respondent(s) : G.A. Ajay Singh .....Petitioner(s) State Of U.P. And 3 Others .....Respondent(s) Investigating Agency, nothing is left in the matter for further adjudication. 5. Learned counsel for the petitioner also submits that the charge-sheet has been filed in the instant FIR and the petitioner has been exonerated by the Investigating Agency. 5. Taking into consideration the submissions advanced by the learned counsel for the parties, in particular, the fact that the investigation has already been completed and a charge-sheet has been filed against the accused, the fact that nothing has been found against the petitioner and he has been exonerated by the Investigating Agency, we are of the view that no fruitful purpose would be served by keeping this petition pending. 6. Accordingly, in view of the above, the present writ petition is disposed of. October 9, 2025 Brijesh Maurya CRLP No. 19544 of 2025 2 (Lakshmi Kant Shukla,J.) (Chandra Dhari Singh,J.)
