HIGH COURT OF JUDICATURE AT ALLAHABAD MATTERS UNDER ARTICLE 227 No. - 10643 of 2025 Court No. - 85 HON'BLE VINOD DIWAKAR, J.
1. Heard learned counsel for the petitioner as well as the learned A.G.A. representing the State-respondent. 2. The present petition has been instituted assailing the order dated 12.08.2025 passed by the learned Sessions Judge, Jalaun at Orai in Sessions Trial No. 85 of 2013, State v. Neeraj @ Chhotu and Others, arising out of Case Crime No. 1017 of 2012, under Sections 147, 148, 452, 302/34 I.P.C., registered at Police Station Konch, District Jalaun, where proceedings under Section 84 of B.N.S.S. have been initiated against the petitioner. 3. Learned counsel for the petitioner submits that despite the matter being listed on four occasions, the anticipatory bail application filed before the learned Sessions Judge has not been decided till date. 4. Learned A.G.A., on the other hand, has invited the attention of this Court to the order of the learned Sessions Judge, wherein it is recorded that proceedings under Section 84 of the B.N.S.S. have already been initiated against the petitioner. 5. This Court is unable to understand as to why the anticipatory bail application has been kept pending once proceedings under Section 84 B.N.S.S. were set in motion. It is not disputed that the application was filed on 28.07.2025 and the matter thereafter came to be listed on 08.05.2025, 25.06.2025 and 09.07.2025; yet, no effective order has been passed. The learned A.G.A. further points out that vide order dated 21.07.2025, the learned Sessions Judge himself recorded a finding that the petitioner has been deliberately delaying the matter and has failed to appear before the Court. In such a situation, there appears no justifiable reason for the trial Court to keep the anticipatory bail application pending, particularly when it was itself of the view that the petitioner was prolonging the proceedings. 6. In the aforesaid facts and circumstances, the present petition stands Versus Counsel for Petitioner(s) : Yogesh Dutta Mishra Counsel for Respondent(s) : G.A. Vinod Chaturvedi .....Petitioner(s) State of U.P. and Another .....Respondent(s)
disposed of with a direction to the learned trial Court to consider and decide the anticipatory bail application of the petitioner on the next date fixed in the matter, strictly in accordance with law, without granting unnecessary adjournments.
