Mr. Vaibhav Singh Chauhan, learned counsel for the applicant. 2. Mr. Pankaj Joshi, learned A.G.A. for the State. 3. Present applicant Abhishek, S/o Shri Rajendra Kumar is praying for bail in relation to FIR dated 15.01.2025, bearing FIR No. 0035 of 2025, registered at P.S. Manglaur, District Haridwar wherein the present applicant has been implicated for the offences punishable under Sections 137(2), 64(2)(e) and 65(1) of BNS 2023 read with Section 3(a)/4(2) and 5(l)/6 of the POCSO Act. 4. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated, and, in fact, applicant and the victim were known to each other and victim refused to go with medical examination and charge sheet has already been filed on 01.03.2025 and applicant is languishing in jail 16.01.2025. He further submits that victim has not support the case of the prosecution. 5. On the other side, Mr. Joshi, learned A.G.A. for the State has not disputed this fact that charge sheet has already been filed , as such, there is no need of custodial interrogation of the applicant. He also apprise to the Court that the applicant has no previous criminal history. 6. After hearing the arguments of the learned counsel for the parties and taking into consideration the fact applicant has no previous criminal 2025:UHC:7171 history and is languishing in jail since 16.01.2025, and the charge sheet has already been filed this Court is of the view that the applicant deserves for bail. 7. Accordingly, without expressing any opinion on the merit of the case, the bail application is allowed. 8. Let the applicant Abhishek be released on bail on his executing a personal bond and furnishing two reliable sureties of the like amount to the satisfaction of the court concerned.
