The present application u/s 528 of BNSS of 2023 has been filed with prayer to quash the ex-parte judgment dated 02.06.2023 passed by Additional Principal Judge, Family Court, Shahjahanpur in Maintenance Case No. 603 of 2019, arising out of an application under Section 125 of Cr.P.C. Learned counsel for the applicant fairly admits that the applicant is wife of deceased Ram Subhash and the applicant is nominee in the Service Book. After some arguments, learned counsel for the applicant does not want to press the present application. In view of above, the present application u/s 528 of BNSS of 2023 is dismissed as not pressed with liberty to file appropriate application/proceedings before the court of competent jurisdiction/Authoority. Certified copies of the relevant documents be returned to learned counsel for the applicant after retaining a photocopy of the same.
