Mr. Rajib Saha is present for the state- respondent and submitted that until and unless the matter is approached before the Sessions Judge there is no scope to entertain the pre-arrest bail application filed by the accused-applicant to this High Court and he also referred one citation of the Hon’ble Chhattisgarh High Court in Hara Ram Sharma and Ors. vs. State of Chhattisgarh through Superintendent of Police and Ors. reported in (2020) 11 CHH CK 0003. From the record it appears that earlier the accused-applicant approached before the Court of Learned Addl. Sessions Judge, Sepahijala District, Bishalgarh but later on the same was withdrawn and why the application was withdrawn is not clear to this Court. However, considering the facts and circumstances of the case the present applicant is at liberty to approach to the concerned court of Learned Addl. Sessions Judge, Bishalgarh accordingly. In the event of rejection of the pre-arrest bail application the accused- applicant shall be at liberty to approach to the High Court. With this observation, this application stands disposed of.
