Heard Shri Viresh Kumar Yadav, learned counsel for the petitioner, Shri Shiv Singh Yadav, learned counsel for respondents No. 1 and 2, and learned standing counsel for respondent No. 3. 2. The following prayer has been made in the present petition: "I. Issus a writ, order or direction in the nature of mandamus commanding the respondent no.2 to consider and decide the application form of the petitioner dated 23.01.2022 having File Number: LK4076091018422 for reissue of passport which is pending since the submission of the application of the petitioner before the respondent no. 2 online." 3. The petitioner has applied for re-issuance of passport and the application filed in this behalf is stated to be pending apparently on account of pendency of criminal cases bearing NCR No.21 of 2019, under Section 323 IPC, Police Station Dakshin Tola, District Mau and Case Crime No. 97 of 2019, under Sections 323, 325 IPC, Police Station Dakshin Tola, District Mau against the petitioner. 4. It has been held by a Coordinate Bench in Writ-C No. 41540 of 2023 (Pawan Kumar Rajbhar vs. Union of India and 2 others) and other connected matters decided on 19.01.2024 that in such an event, it is open to the person concerned to seek no-objection from the jurisdictional criminal court in respect of re-issuance of passport and the Regional Passport Officer shall act, accordingly.
