The petitioner has brought to the notice of the Court that the order dated 31.12.2024, passed by this Court in WPSS No.2434 of 2024, Mohd. Faisal Vs. State of Uttarakhand (“the first petition”), has been wilfully disobeyed by the respondents. On 18.07.2025 the Court had required learned State Counsel to get instructions in the matter. Today, at the very outset, learned State Counsel submits that the petitioner has never been discontinued from services. He has placed for the perusal for the Court the written instructions. Let it be taken on record. The written instructions records that the order dated 31.12.2024, passed by this Court in the first petition has never been disobeyed. The petitioner has been posted in Bageshwar, which was a part of continuing his services, but the petitioner did join on 16.06.2025, and, thereafter, he his absenting himself. Learned counsel for the petitioner submits that the petitioner did receive order for joining on 02.08.2025. These are disputed questions, but the report, as tendered by learned State Counsel, reveals that the petitioner is absenting himself, and it is also the case of the Director, Panchayati Raj, Dehradun, that the services of the petitioner were never discontinued. If an order is passed by the Court for not disturbing the services of a person, it does not give him a liberty for absenting without permission or cause. In such eventuality, the department shall proceed against such officer/official, as is permissible under law. Since it is brought to the notice of the Court that the order dated 31.12.2024, passed by this Court in the first petition has never been disobeyed, and the services of the petitioner has never been discontinued, nothing survives in this contempt petition.
