2. The petitioners apprehend their arrest in a case registered for the offence under Sections 127(1), 115(2), 109, 305(a), 352, 351(2)/3(5) of the Bhartiya Nyaya Sanhita.
3. As per the prosecution case, on 02.07.2024, the informant demanded money from her husband Rajesh Yadav, and thereafter, all the accused persons including petitioners assaulted informant with lathi and danda and also committed theft of her jewelleries from her box. It is further alleged that when informant’s son protested, he was assaulted by petitioner no. 2 (Babi Devi) by means of iron rod.

Learned counsel for the petitioners submits that petitioner no. 1 is elder brother-in-law (tsB) of informant and petitioner no. 2 is his (petitioner no. 1) wife i.e. tsBkuh and due to family feud, this false and concocted case has been lodged. Allegation is general and omnibus. Injury, allegedly caused by petitioner no. 2, is simple in nature. Rest of the allegation is only ornamental. Petitioners claim clean antecedent.
5. Learned A.P.P. for the State has opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Amarpur P.S. Case No. 449 of 2024, subject to condition as laid down under Section 482(2) of the Bhartiya Nagrik Suraksha Sanhita, 2023.
