Perused the materials available on record and also gone through the impugned order. 2. This bail application has been filed to release the petitioner on regular bail in connection with Mandar P.S. Case No.25 of 2023 corresponding to G.R. Case No.1152 of 2023, for allegedly committing offence punishable under Section 392 of the Indian Penal Code, pending before the Court of learned Judicial Magistrate-1st Class, Ranchi. 3. The application of this petitioner for grant of regular bail was earlier rejected by this Court vide order dated 17.05.2024 passed in B.A. No.4030 of 2024. 4. Opportunity was given to the State to oppose the bail application, which the State availed and opposed. 5. Learned counsel for the petitioner submits that though in the Test Identification Parade, the informant had identified this petitioner to be one of the miscreants but while deposing as PW3, he stated that he cannot identify the miscreants in the Court as at the relevant time the miscreants were wearing helmet. 6. Considering the fact that the petitioner is in custody since 21.02.2023 and the informant had not identified him in the Court, I am inclined to release this petitioner on bail. 2025:JHHC:11074 2 7. Accordingly, the present Bail Application is allowed. The petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st Class, Ranchi, in connection with Mandar P.S. Case No.25 of 2023 corresponding to G.R. Case No.1152 of 2023 with the condition that atleast once in a month he will appear and mark his attendance before the Trial Court. (ANANDA SEN, J.) Tanuj/Cp-2
