JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 2 11-02-2025 Heard learned counsel for the petitioners and learned A.P.P for the State. 2. The petitioners apprehend their arrest in a case registered for offence under Sections 80(2), 61(2) of B.N.S., 2023. 3. As per prosecution case, sister of informant was married with petitioner no. 1 on 22.02.2023 and when she went to her matrimonial house, all the petitioners started demanding Patna High Court CR. MISC. No.1609 of 2025(2) dt.11-02-2025 2/2 dowry and due to non-fulfillment of the same, she was subjected to cruelty and harassment and as such, on 06.11.2024, she committed suicide at her parental house. 4. Learned counsel for the petitioners submits that informant is not eye-witness to the occurrence and only on suspicion, petitioners have been made accused. As a matter of fact, the deceased committed suicide at her parental house. He further submits that petitioner no. 1 has already filed a divorce case i.e. Matrimonial Case No. 1358 of 2023 in the Court of learned Principal Judge Family Court, Patna on 31.10.2023 due to mental / abnormal condition of deceased. 5. However, learned A.P.P. for the State vehemently opposes the prayer for anticipatory bail and submits that there is specific allegation of demand of dowry and committing torture against these petitioners. Deceased died within seven years of marriage in an unnatural circumstances. 6. Considering the aforesaid facts and circumstances, the prayer for anticipatory bail of petitioners is rejected. anay (Prabhat Kumar Singh, J) U T
