Issue a Writ of Certiorari by quashing the endorsement as ANNEXURE-B issued by the 2nd Respondent endorsement No.CPB/CTP-SEC/29 DATED: 01/04/2025 by directing the Respondent No.2/Central Prison, Bangalore, to release the Petitioner on parole for a period of 90 days in prisoner CTP No.13750 convicted by the judgment and order dated 19.07.2023 passed by the Hon'ble Additional District and Sessions Judge (FTSC-II), Bengaluru Rural District, Bengaluru in Spl.C.No.98/2015 for the offences vide vide Annexure-A punishable U/sec.376, 302 of IPC and Section 6 of the POCSO Act vide Annexure-A, in the interest of justice and equity. 2. Issue such other suitable orders or direction as this Hon'ble court deems fit and proper in the nature and circumstances of the case, in the interest of justice and equity. 2. The detenu Ambaresha (CTP No.13750) had been convicted in Sp.C.No.98 of 2015 by the Additional District and Sessions Judge (FTSC-II), Bengaluru - 3 - HC-KAR NC: 2025:KHC:53264 WP No. 33870 of 2025 Rural District, Bengaluru and sentenced on 19.07.2023 to undergo rigorous imprisonment for life which have been imprisonment shall be from the remainder of the detenu natural life for offences under Section 302, 376 of the IPC and under Section 6 of the POCSO Act taking into consideration the victim was 8 year old girl. 3. The Sessions Court having categorically indicated that the detenu would have to undergo imprisonment for the remainder of his natural life, I am of the considered opinion that no parole can be granted.
