HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - C No. - 31591 of 2025 Court No. - 34 HON'BLE ROHIT RANJAN AGARWAL, J. 1. Proceeding under Section 67 of U.P. Revenue Code, 2006 was initiated against petitioner over Gata No. 281 which is recorded as khalihan in the revenue records. The said land is a public utility land and petitioner has made certain constructions over the same. Proceedings were contested by petitioner and he filed his objections on 20.02.2018 wherein in para no. 5, it has been specifically mentioned that he is not aware of the fact on which gata his house is situated. Moreover, petitioner has admitted that certain temporary construction is standing over the land in question and his house is near it. The eviction order has been passed which has been confirmed in appeal. 2. From perusal of the order impugned, I find that no interference is required as it is an admitted case that temporary structure is standing over Gata No. 281 which is recorded as khalihan. 3. Writ petition fails and is hereby dismissed. 4. However, the petitioner is at liberty of moving application under Section 67-A of U.P. Revenue Code, 2006 before authorities for settling the land as abadi side in his favour in case he does not have house and the house has been constructed over the same.
