The petitioner has been made accused in connection with Birni P.S. Case No.226 of 2024 registered under Sections 310 (4) (5) of the B.N.S., 2023 and Section 25 (1-b) a/26/35 of the Arms Act. Learned counsel for the petitioner submits that the allegation against the petitioner is that fire-arms were recovered from the co-accused persons and the petitioner has been implicated in this case on the basis of the same. It is submitted that the allegation against the petitioner is false. Drawing attention of this Court towards para-15 of the instant bail application, learned counsel for the petitioner submits that the petitioner has no criminal antecedent. It is then submitted that the petitioner undertakes that he will co-operate with the trial of the case. It is also submitted that charge-sheet has already been submitted in this case. It is lastly submitted that the petitioner has been in custody since 22.12.2024 as is evident from para-16 of the instant bail application. Hence it is submitted that the petitioner be released on bail. Learned Addl. P.P. opposes the prayer for bail. Considering the facts of this case, the above-named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Giridih in connection with Birni P.S. Case No.226 of 2024 with the condition that he will co-operate with the trial of the case and furnish his mobile number and photocopy of the Aadhar Card in the court below with an undertaking that he will not change his mobile number during the trial of the case.
