Heard Mr. H. R. A. Choudhury, learned Senior Counsel assisted by Mr. R. A. Choudhury, learned counsel for the petitioner. Also heard Mr. K. K. Parasar, learned Additional Public Prosecutor for the State respondent. This is an application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, praying for the grant of pre-arrest bail to the accused/petitioner, who apprehends arrest in connection with Mankachar P.S. Case No. 207/2024, registered under Sections 140(3)/117(2)/127(3)/3(5) of the BNS. The Case Diary called for has already been received. It is submitted by Mr. Choudhury, learned Senior Counsel that after obtaining interim pre-arrest bail, the petitioner appeared before the IO on 17.03.2024, and cooperated in the investigation and his statement is also recorded under Section 161 of the Cr.P.C. He further submits that the petitioner is ready and willing to cooperate in the further investigation, if his interim pre- arrest bail is extended, and he affirms his readiness to abide by any conditions imposed on him. In this context, Mr. Sharma, learned Additional Public Prosecutor, has submitted that the accused/petitioner is cooperating in the investigation and accordingly, he submits that the petitioner’s prayer may be allowed. After hearing the submissions of learned counsels for both sides and considering the materials available in the Case Diary and the cooperation of the
Page No.# 3/3 petitioner during the investigation, I find it appropriate to extend the privilege of pre-arrest bail to the accused/petitioner. Therefore, the interim pre-arrest bail granted to the accused/petitioner vide order dated 17.03.2025, is hereby made absolute, with a direction to co-operate with the IO in the further investigation of the case. In light of the above, this anticipatory bail application stands disposed of.
