PUBLIC PROSECUTOR The Court made the following: 2 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA CRIMINAL PETITION NO: 2103 of 2025 ORDER: This Criminal Petition, under Sections 484(2)(b) of the Bharatiya Nagarik Suraksha Sanhita, 2023 and 439(1)(b) of Cr.P.C., has been filed by the petitioner/A1, seeking to modify the order passed by the learned Metropolitan Sessions Judge-cum-I Additional District & Sessions Judge- Special Judge for Trial of Offences Under NDPS Act, Visakhapatnam in Crl.M.P.No. 3297 of 2024 in Crime No. 304 of 2019 dated 07.01.2025. 2. None represented on behalf of the Petitioner/Accused No.1. 3. The present Criminal Petition is filed seeking modification of the condition of bail, wherein the Trial Court directed the petitioner to be released on executing a personal bond for Rs. 1,00,000/- (Rupees One lakh only) with two sureties. Now the Petitioner seeks modification of the condition of executing “a personal bond for Rs.1,00,000/-with two sureties” to “a personal bond for Rs.10,000/- with two sureties”. 4. Ms. K. Priyanka Lakshmi, learned Assistant Public Prosecutor would submit that the petitioner was produced before the Court on execution of non- bailable warrant. Learned Assistant Public Prosecutor would further submit that he is involved in other cases also. Rowdy sheet is also pending against him. Learned Assistant Public Prosecutor finally submits that the Court may pass appropriate Orders. 3 5. The record shows that the petitioner was granted bail on 07.01.2025. Till this day, the Petitioner could not produce sureties because of his poor condition. Considering the same, the bail condition “petitioner/A1 to be released on bail on executing a personal bond for Rs.1,00,000/- (Rupees One Lakh only) with two sureties” is modified as “petitioner/A1 to be released on bail on executing a personal bond for Rs.20,000/- (Rupees Twenty Thousand only) with two sureties”. 6. In the result, the Criminal petition is allowed.
