The petitioner- Birendra Kumar Sah @ Biru is in custody since 24.02.2023 in connection with S.T. No.125 of 2024 arising out of Mirzachowki P.S. Case No. 16 of 2023, corresponding to G.R. No.264 of 2023 for the offence registered under Sections 25(1-a), 26(2), 29 and 35 of the Arms Act pending in the Court of learned Additional Sessions Judge-III, Sahibganj. Earlier bail application of this petitioner was rejected vide order dated 06.09.2024 with a direction to conclude the trial preferably within six months from the date of the order. It is submitted by learned counsel on behalf of petitioner that the petitioner is languishing in jail custody for more than two years and not a single charge sheeted witness has been examined till date. Learned A.P.P. opposed the prayer for bail. Under the circumstances, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below.
