The applicant has preferred this anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of Anticipatory Bail, apprehending his arrest in connection with Crime No. 16/2025, registered at Police Station – Simga, District – Balodabazar- Bhatapara (C.G.) for alleged commission of offence punishable under Sections 325, 111 and 3(5) of the Bharatiya Nyaya Sanhita, 2023 (BNS) and Sections 4, 5 and 10 of Chhattisgarh Krishak Parirakshan Adhiniyam and Sections 49, 49(A), 50 and 11 of Pashuvon Ke Prati Krurta Niwaran Adhiniyam and Section 39/192, 146/196, 03/181, 56/192 and 184/192 of the Motor Vehicle Act. As per the prosecution story in brief, is that on 08.01.2025 at about 4.30 AM, the police has received information through the informant that some persons have taken animals in the slaughter house in the Truck No. MH- 40-CM-6089 illegally and without giving any food to the said animals and over numbers of the animals and on the basis of said information, a raid was conducted and recovered total 40 numbers of animals in the said truck, when the police asked their name, they disclosed their names as Ghanshyam Pal Son of Madan Pal, Mohammad Irshad Ansari son of Ayyub Ansari and Dheeraj Reddy Son of Anil Reddy, on the basis of memorandum of the witness namely Manoj Janghel, the present applicant has been implicated in this crime. Hence, this application. 3. The learned counsel for the applicant has argued that the applicant is completely innocent and further submitted that the name of the applicant has not been mentioned in the First Information Report. Hence, he prays for grant of anticipatory bail to the applicant. 4.
On the other hand, learned State counsel opposed the prayer for grant of anticipatory bail and submitted that, it transpires that on 08.01.2025 at about 4.30 AM, the police has received information through the informant that some persons have taken animals in the slaughter house in the Truck No. MH-40-CM-6089 illegally and without giving any food to the said animals and over numbers of the animals and on the basis of said information, a raid was conducted and recovered total 40 numbers of animals in the said truck, and out of which 8 were dead and 32 were alive, and the name of the applicant is also mentioned in the FIR. Therefore, the present anticipatory bail application of the applicant is liable to be rejected. 3
5. I have heard learned counsel for the parties and perused the material available on record. 6. Considering the facts & circumstances of the case, allegations levelled against the applicant in the FIR, and from the perusal of the records available, it transpires that on 08.01.2025 at about 4.30 AM, the police has received information through the informant that some persons have taken animals in the slaughter house in the Truck No. MH-40-CM-6089 illegally and without giving any food to the said animals and over numbers of the animals and on the basis of said information, a raid was conducted and recovered total 40 numbers of animals in the said truck, and out of which 8 were dead and 32 were alive, and the name of the applicant is also mentioned in the FIR, thus, I am not inclined to grant anticipatory bail to the applicant. 7.

Accordingly, the Anticipatory Bail application of the applicant – Revat Katle Urf Kundan Katle, filed under Section 482 of the BNSS, 2023 in connection with Crime No. 16/2025, registered at Police Station – Simga, District – Balodabazar-Bhatapara (C.G.) for alleged commission of offence punishable under Sections 325, 111 and 3(5) of the BNS and Sections 4, 5 and 10 of Chhattisgarh Krishak Parirakshan Adhiniyam and Sections 49, 49(A), 50 and 11 of Pashuvon Ke Prati Krurta Niwaran Adhiniyam and Section 39/192, 146/196, 03/181, 56/192 and 184/192 of the Motor Vehicle Act, is rejected.
