JUSTICE ANIL KUMAR SINHA ORAL ORDER 2 11-02-2025 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. 2. This application, for grant of anticipatory bail, arises out of Belsand P.S. Case No. 147 of 2024, registered for the offence under Sections 223, 224, 191(2), 191(3), 190, 192, 292, 126(2), 115(2), 121, 109, 132, 324(4), 352, 351(3), 299, 326(1) of the B.N.S. and Section 3 of the Loud Speaker Act 3. The prosecution case, as per the First Information Report, is that on 12.10.2024, while the informant with other police forces were on duty on the occasion of immersion of Maa Durga idol, the accused persons including the petitioner and 1000-1200 others were variously armed with lathi, Bhala, Garasa, sword etc., reached near Masjid, they started raising slogans against a religion on DJ. The informant and other police Patna High Court CR. MISC. No.525 of 2025(2) dt.11-02-2025 2/3 forces tried to pacify them but of no effect. The people of two community started pelting stones on each other. During that course some police personnels also sustained injury. The accused persons also set fire in the shop of Md. Kajim. The accused persons were raising slogans against the administration and they disturbed the informant and other police forces in discharging their official duty. 4. Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and has falsely been implicated in the present case due to village politics. There is no any specific overt act alleged against the petitioner. 5. Having regard to the submissions made on behalf of the parties and taking into consideration the nature of allegation and the fact that petitioner is having ten criminal antecedents and petitioner along with other co-accused persons, were indulged in pelting stones and firing upon the police officials and the fact that attack on police while on official duty undermines the safety and security of law enforcement agency, incident of mob violence against law enforcement agency has become order of the day now in the State which can be very dangerous, often escalating tensions and compromising public Patna High Court CR. MISC. No.525 of 2025(2) dt.11-02-2025 3/3 safety, accordingly, I am not inclined to grant the petitioner privilege of anticipatory bail. 6.
