Heard the learned counsel for the petitioner as well the learned counsel for the respondent. 3. The learned counsel for the petitioner would bring to my notice, earlier filing of HMOP No.181 of 2024 before the Sub Curt, Udumalpet by the petitioner/wife seeking divorce, whereas, the respondent/husband has filed HMOP No.39 of 2025 before the Sub Court, Ambattur seeking restitution of conjunction rights. 4. Admittedly, the petitioner is a resident of Periyakottai, Udumalpet Taluk and her HMOP No.181 of 2024 for divorce is pending on the file of Sub Court, Udumalpet. The learned counsel for the respondent/husband, on instructions from the respondent, fairly states that both the OPs have to be necessarily tried together and he only seeks for exemption of the respondent’s physical appearance before the Sub Court, Udumalpet for ordinary hearing dates. 5. In view of the above, this transfer civil miscellaneous petition is ordered with the following directions. i) HMOP No.39 of 2025 is withdrawn from the file of Sub Court, Ambattur and transferred the same to the file of Sub Court, Udumalpet, to be jointly tried along with HMOP No.181 of 2024. __________ Page2 of 4 https://www.mhc.tn.gov.in/judis TR CMP No. 985 of 2025 ii) The transferee court, namely the Sub Court, Udumalpet shall not ordinarily insist on the presence of the respondent for all hearing dates and the respondent shall be entitled to engage a counsel of his choice, except o hearings, when his presence would be mandatory. iii) The Sub Judge, Ambattur is directed to send the entire records with regard to HMOP No.39 of 2025 to the file of Sub Court, Udumalpet, forthwith.
