ORDER 29-08-2025
1. The petitioners have alleged non-compliance of order dated 05.10.2015, whereby SWP No. 2338/2018 was disposed of with the following directions:
“In view of the aforesaid statement of the learned counsel for the petitioners, the writ petition is disposed of with a direction to the respondents to accord consideration to the claim of the petitioners as detailed in the writ petition. Needful, on the part of the respondents, be done strictly in accordance with the law and the rules governing the field within a period of four weeks' time from the date the certified copy of this order alongwith the writ petition with all its annexures is made available to them by the petitioners.”
2. The respondents have filed a compliance report stating therein that the claim of the petitioners has been duly considered and rejected by passing a speaking order. The said consideration order, bearing No. 66 dated 18.08.2025, passed by the Chief Engineer, PW(R&B) Department, North Kashmir, has been placed on record along with the compliance report.
3. On perusal of the compliance report, it appears that the respondents have complied with the directions passed by the writ court in its letter and spirit.
4. Accordingly, the proceedings in the present contempt petition are closed and rule, if any, shall stand discharged. However, liberty is reserved to the petitioners to challenge consideration order No. 66 dated 18.08.2025, passed by the Chief Engineer, PW(R&B) Department, North Kashmir, if so advised.
5. Disposed of.
