JUSTICE J.M.KHAZI ORAL ORDER Both learned counsel for the petitioners and respondent No.2/complainant as well learned High Court Government Pleader for respondent No.1/State are present. 2. This petition is filed by the petitioners/accused Nos.2 and 3 under Section 482 of Cr.P.C, to quash the - 3 - HC-KAR NC: 2025:KHC:32606 CRL.P No. 9739 of 2022 entire proceedings in C.C.No.19099/2022, for the offences punishable 498A, 504, 506 of I.P.C and Section 4 of Dowry Prohibition Act. 3. A joint affidavit is filed by the petitioners and respondent No.2 stating that the matter is settled between the parties. The photo copy of the order-sheet and a copy of memorandum of settlement filed in M.C.No.4543/2023 is also produced. The joint affidavit reads as under: " 1. We the petitioner No.1, No.2 and Respondent No.2 respectfully submit that, we are fully acquainted with the facts and circumstances of the above case. I, the respondent No.2 had lodged a complaint against the present petitioners No.1 & 2/Accused No.2 & 3 and the Accused No.1 before Basavanagudi Womens Police Station, pursuant to which an FIR was registered in Crime No.81/2022 for the offences punishable under Sections 498(A), 504, & 506 of I.P.C., 1860 and Section 4 of Dowry Prohibition Act, 1961. Subsequent to investigation, a charge sheet has been filed for the said offences before the 37th ACJM, Bangalore in C.C. No.19099/2022. - 4 - HC-KAR NC: 2025:KHC:32606 CRL.P No. 9739 of 2022 2. We further submit that, the Petitioner No.1 & 2/Accused No.2 & 3 has approached this Hon'ble Court seeking quashing of the complaint, FIR, and charge sheet insofar as they pertain to them. 3. Upon consideration of the facts and circumstances, I state that, it being a family dispute, the son of the Petitioner No.1 & 2 i.e., the Accused No.1 have entered into Memorandum of Settlement under Section 89 of CPC R/w Rules 24 and 25 of Karnataka Civil Procedure (Mediation) Rules, 2005 with the Respondent No.2 and all the other cases have been disposed off amongst the parties as settled and a decree of Divorce has been granted by the learned IV Addl. Principal Judge, Family Court in M.C No.4543/2023 on 30.07.2025. The copy of the Decree along with the Memorandum of Settlement is produced along with this Affidavit for kind perusal of this Hon'ble Court. 4. The parties have also decided for quashment of the above case. The Respondent No.2 therefore has no subsisting grievance, monetary claim, or other demand against the Petitioner No.1 & 2 in connection with the present matter. WHEREFORE, in view of the above, we most respectfully pray that this Hon'ble Court may be pleased to allow the Petition and quash the Complaint, FIR and charge sheet in - 5 - HC-KAR NC: 2025:KHC:32606 CRL.P No. 9739 of 2022 C.C No.19099/2022 pending before the 37th Addl. Chief Judicial Magistrate at Bengaluru of the Respondent No.1 - Basavanagudi Women Police Station, Bengaluru for the offences punishable under Sections 498(A), 504 & 506 of I.P.C., 1860 and Section 4 of Dowry Prohibition Act, 1961 only insofar as they relate to the Petitioner No.1 & 2/Accused No.2 & 3, in the interest of justice and equity". 4. Respondent No.2/complainant admits the compromise and submits that she has no objection to allow the petition and quash the criminal proceedings against petitioners. The terms and conditions of compromise petition are legal and equitable. The same is accepted and accordingly, following: ORDER (i) The petition filed under Section 482 Cr.P.C, is allowed. (ii) The entire proceedings in C.C.No.19099/2022 on the file of XXXVII - 6 - HC-KAR NC: 2025:KHC:32606 CRL.P No. 9739 of 2022 Additional Chief Judicial Metropolitan Magistrate, Bengaluru, is hereby quashed.
