Instructions have been placed before this Court by learned Standing Counsel and are taken on record. 2. Heard learned counsel for the parties and perused the record. 3. This petition has been filed for the following relief: "issue any other, order or direction in the mandamus directing to the respondents authority to direct the respondent no. 2, to decide the application dated 25.05.2023, in pursuance of order dated 27.05.2013 passed by Sub-District Magistrate Kasya, District Kushinagar in case no. 80 of 2012 (Munarasan Vs. Kishor and others) under section 41 L.R. Act, within stipulated period, pending before learned court of Sub- District Magistrate, Kasya, District Kushinagar. (Annexure no. 5 to this writ petition)." 4. On the basis of instructions, learned Standing Counsel has stated that a restoration application has been filed by one Prahlad and on the aforesaid restoration application, operation of order dated 27.05.2013 has been stayed and the aforesaid proceedings are pending and 04.04.2025 is the date fixed. 5. Since, restoration application is pending and there is an interim order, therefore, no further orders can be passed in this writ petition. 6. Accordingly, the writ petition is disposed of with a direction to respondent no. 2 to decide the restoration application in accordance with law, expeditiously, after providing opportunity of hearing to the petitioner, provided that there is no other legal impediment.
