1. The petitioner has filed the instant petition under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 with a prayer to grant regular bail in case FIR No.207 dated 23.05.2025 registered under Sections 304, 115(2), 3(5) of BNS, 2023 (Sections 61(2) and 317(2) of BNS, 2023 added later on), at Police Station City Barnala.

Learned counsel for the petitioner contends that the petitioner has been falsely implicated in the present case and was arrested on 24.05.2025. He next contends that it has been alleged that the petitioner was driving a motorcycle, whereas Hardeep Singh @ Gora had snatched the chain from the victim. However, Hardeep Singh @ Gora has been admitted to bail by the Court of Chief Judicial Magistrate, Barnala, vide order dated 16.07.2025 (Annexure P-4). 3. On the other hand, learned State counsel has vehemently opposed the submissions made by learned counsel for the petitioner on the ground that serious allegations have been levelled against the present petitioner and he does not deserve the concession of bail by this Court.
4. I have heard the learned counsel for the parties and perused the record.
5. In the present case, the petitioner is stated to be in custody for the last about 03 months. However, the main accused, Hardeep Singh @ Gora has been granted the concession of bail by the Court of Chief Judicial Magistrate, Barnala, vide order dated 16.07.2025 (Annexure P-4).
6. Without commenting on the merits of the case, the present petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing bail bonds/surety bonds to the satisfaction of the trial Court/Duty Magistrate/Chief Judicial Magistrate, concerned.
