This petition is filed by accused No.1 under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 (for short hereinafter referred to as 'BNSS'), praying to grant anticipatory bail in Crime No.433/2025 of Ramamurthy Nagar Police Station registered for offences punishable under Sections 120B, 420, 471, 465 and 468 of IPC. 2. Heard learned counsel for petitioner and learned High Court Government Pleader for the respondent - State. 3. Learned counsel for petitioner would contend that there is an allegation against this petitioner for creating the documents pertaining to two sites bearing Nos.19 and 24 belonging to the complainant. In respect of each plot, two cases came to be registered, one in Crime No.430/2025 and the other in Crime No.433/2025. The petitioner came to be arrested in respect of Crime No.430/2025 on 06.08.2025 and - 3 - HC-KAR NC: 2025:KHC:51923 CRL.P No. 13195 of 2025 he has been granted bail in the said Crime on 12.08.2025. The petitioner has not been taken into custody in the present crime even though it was registered on 07.07.2025. The petitioner has been interrogated in Crime No.430/2025. The petitioner is ready to co-operate with the police in the investigation and abide by any conditions to be imposed by this Court. The petitioner is the resident of Bangaluru and the offences alleged against him are not punishable either with death or imprisonment for life. With this, he prayed to allow the petition. 4. Per contra, learned High Court Government Pleader would contend that inspite of issuing notice to appear for investigation, the petitioner has not appeared before the Investigating Officer for investigation. The petitioner has created the documents pertaining to two sites of the complainant. The petitioner is required for interrogation and collection of original documents from him. The petitioner is the resident of Andhra Pradesh. With this, he prayed to reject the petition. - 4 - HC-KAR NC: 2025:KHC:51923 CRL.P No. 13195 of 2025 5. Having heard the learned counsel, the Court has perused the F.I.R, complaint and the other material placed on record. 6. As per the F.I.R, the allegation against the petitioner is that he has created the document pertaining to two sites of the complainant and sold them to different persons. The case of the prosecution is based on the documents. The petitioner was already been interrogated by the police in Crime No.430/2025 which is registered pertaining to one site, the present Crime No.433/2025 is registered pertaining to another site of the complainant. The petitioner has undertaken to co-operate with Investigating Officer in the investigation and abide by any condition to be imposed by this Court. The offences alleged against the petitioner are not punishable either with the death or imprisonment for life. 7. Considering the above aspects, the petitioner has made out a case for grant of anticipatory bail with conditions. In the result, the following; - 5 - HC-KAR NC: 2025:KHC:51923 CRL.P No. 13195 of 2025 ORDER The petitioner is ordered to be released on bail in the event of his arrest in Crime No.433/2025 of Ramamurthy Nagara Police Station, subject to the following conditions; (i) The petitioner shall voluntarily appear before the Investigating Officer within ten days from this day and execute a personal bond for a sum of ₹1,00,000/- with one surety for the likesum to the satisfaction of the Investigating Officer. (ii) The petitioner shall appear before the Investigating Officer whenever called for and co- operate for the investigation. (iii) The petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.
