JUSTICE PARTHIVJYOTI SAIKIA O R D E R 13.03.2025 I have heard Mr. PK Roychoudhury, the learned counsel appearing for the petitioner. Also heard Mrs. N. Das, the learned Addl. Public Prosecutor, Assam. 2. This is an application under Section 483 of the BNSS, 2023 whereby the petitioner Sarbat Mullah has prayed for releasing him on regular bail after he was Page No.# 2/2 arrested in connection with Basistha P.S. Case No.106/2025. 3. On 15.02.2025, a laptop computer was stolen from the house of the informant. An FIR was lodged to that effect. On the basis of CC TV footage, the thieves were arrested by police. 4. The present petitioner owns a Mobile Repairing Shop. It is stated by him that some boys gave him the laptop in order to sale it but he did not have any documents. Those boys went away by keeping the laptop in his shop and said that they will come back with documents. In the meantime, police arrived there. The laptop was recovered and the present petitioner was arrested. 5. The petitioner submits that for lack of documents, he did not buy the laptop. But he admitted that the laptop was kept in his shop by some unknown boys. The petitioner also submits that he has to go to Hyderabad for a surgery of his prostate and therefore, he had withdrawn an amount of ₹4,50,000/- from his Bank Account. According to the petitioner, the said money was also taken away by police. 6. I have considered the submissions made by the learned counsel of both sides. 7. At this stage, considering the medical condition, this Court is of the opinion that the present petitioner no longer deserves to be detained in custody under the given circumstances. Therefore, his bail application is allowed. 8. The petitioner Sarbat Mullah who was arrested in connection with Basistha P.S. Case No.106/2025, is allowed to go on bail of ₹20,000/- with a surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Kamrup (M), Guwahati, Assam.
