[2025:RJ-JP:9630] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous 2nd Bail Application No. 3045/2025 Hariprasad @ Hari Lal S/o Kesara, Aged About 61 Years, R/o Negadiya, Tehsil Devli, Distt. Tonk (At Present Accused Petitioner Is Confined In Distt. Jail Tonk) ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Vijendra Yadav For Respondent(s) : Ms. Arti Sharma, PP HON'BLE MR. JUSTICE ANIL KUMAR UPMAN Order 05/03/2025 Vide order dated 04.12.2024, first bail application of the petitioner was dismissed as withdrawn with liberty to file fresh bail application after recording the testimony of eye-witnesses as well as medical expert who conducted post-mortem of the deceased. Having regard to the totality of facts and circumstances of the case, so also the fact that there is no change in circumstances after dismissal of the first bail application, thus, I do not find any good ground to change my earlier view. Accordingly, this criminal second bail application is dismissed. However, learned trial court is directed to record the testimony of eye-witnesses as well as medical expert who conducted the post-mortem of the deceased on priority basis.
