For the State : AC to AAG-II ----- 04/ 28.04.2025 It is the case of the petitioner that the police inspite of receipt of information which constitute cognizable offence is not registering any case. It is the case of the petitioner that a Mandamus may be issued to the Jagarnathpur police station to institute a FIR based on the information given by the petitioner. 2. It is well settled that if cognizance offence is made out the police official is bound to register a FIR and investigate the same. It is also made clear that if no FIR is lodged, there is provision under BNSS which can be availed by the petitioner. Admittedly, the petitioner has not availed the aforesaid statutory provision rather has rushed to this Court. 3. Thus, I direct the petitioner to avail the statutory remedies as available to him. The petitioner is directed to approach and take recourse of the statutory remedies available to the petitioner in this case. 4. This writ application is disposed of. (ANANDA SEN, J.) Tanuj/
