Neutral Citation No. - 2025:AHC:17772 Court No. - 4 Case :- WRIT - A No. - 637 of 2025 Petitioner :- Mansha Rai (Staff Nurse) And Another Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Dinesh Kumar Yadav,Vivek Kumar Yadav Counsel for Respondent :- C.S.C. Hon'ble Ajit Kumar,J. Heard Sri Dinesh Kumar Yadav, learned counsel for the petitioners and learned Standing Counsel for the State respondents. By means of this petition filed under Article 226 of the Constitution, petitioners have questioned the transfer order dated 18th December, 2024 on the ground that thrice they have been transferred from one place to another place. It is submitted by learned counsel for the petitioners that petitioners are being harassed only by certain influential persons and hence there is an act of arbitrariness in exercise of power. Per contra, it is submitted by learned Standing Counsel that petitioners have been transferred in administrative exigency and the transfer order is within the district and, therefore, this Court may not interfere with the transfer order. Having heard learned counsel for the respective parties and having perused the records, I find it appropriate for the petitioners to make fresh individual representations before the competent authority, namely respondent No.- 2 within a period of three weeks from today against the transfer order dated 24th January, 2024 and in the event any such representations are made as directed herein above, the same shall be considered and disposed off on its own merit by means of a reasoned and speaking order within a further period of three weeks. With the aforesaid observations and directions, this petition stands disposed of. Order Date :- 6.2.2025 Atmesh Digitally signed by :- ATMESH KESARI High Court of Judicature at Allahabad
