Sharma, learned Additional Public Prosecutor for the State respondent No. 1. This is an application under Section 483 of BNSS, 2023 praying for grant of bail to the accused/petitioner, who has been arrested in connection with Sootea P.S. Case No. 13/2025 (corresponding to GR Case No. 68/2025), under Section 12 of POCSO Act, 2012. Mr. Sharma, learned Additional Public Prosecutor, submitted that though the case was listed today for production of the Case Diary before this Court, but the case has already been Charge-Sheeted, vide Charge-Sheet No. 12/2025, dated 28.02.2025. In this context, Mr. Baruah, learned counsel for the petitioner, has submitted that the accused/petitioner is innocent and he is no way connected in the alleged offence. However, he has been arrested in connection with the case on 06.02.2025 and for last 61 days, he has been in custody. Considering the submissions of learned counsels for both sides and also considering the fact that the case has already been Charge-Sheet, vide Charge- Sheet No. 12/2025, dated 28.02.2025, the accused/petitioner is hereby directed Page No.# 3/3 to appear before the learned Court below with an appropriate application for bail, which shall be considered by the learned Trial Court in accordance with law.
