ORAL ORDER This petition is filed by accused No.1 under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 praying to grant bail in Crime No.442/2025 of Varthuru Police Station registered for the offence punishable under Section 80 and Section 3(5) of Bharatiya Nyaya Sanhita, 2023.
2. Heard the learned counsel for petitioner and learned High Court Government Pleader for respondent/State.

learned counsel for petitioner would contend that, the marriage of the petitioner and the deceased was a love marriage, and the parents of the deceased have not agreed for the said marriage. The

petitioner and the deceased were working in Bangalore, and residing in a rented house. There was no any demand by the petitioner, and his mother of any dowry. The deceased after her marriage had not gone to the house of her parents. There was no any complaint by the deceased prior to her death against the petitioner. The petitioner is in judicial custody since 28.08.2025, and therefore, he is not required for custodial interrogation. With this, he prayed to allow the petition. 4. Per contra, the learned High Court Government Pleader for respondent/State would contend that, the charge sheet has been filed. The offence alleged against the petitioner is Section 80 of BNS, 2023. It is punishable with imprisonment for a period of not less than seven years. The death of the deceased is within seven years of the marriage. The deceased committed suicide due to harassment and ill-treatment given by the petitioner demanding to bring site and dowry from her parents. tampering the prosecution witnesses. With this, he prayed to reject the petition,
5. Having heard the learned counsel, the Court has perused the FIR, complaint and other materials placed on record. 6. The marriage of the petitioner and the deceased was a love marriage. The averments of first information indicate that, the parents of the deceased have not agreed for the marriage of petitioner with the deceased. It is further stated that, the deceased was in contact with the first informant over phone. The deceased was residing with her husband in a rented house in Bangalore. There was no any complaint against the petitioner by the deceased regarding any demand of dowry or harassment prior to her death. The petitioner is in judicial custody since 28.08.2025, and as charge sheet is filed, he is not required for custodial interrogation. There are no criminal antecedents of the petitioner. - 5 -

Considering the above aspects, the petitioner has made out a case for grant of bail with conditions. In the result, the following
ORDER
i) The petition is allowed.
ii) The petitioner is granted bail in Crime No.442/2025 of Varthuru Police Station registered for the offence punishable under Section 80 and Section 3(5) of Bharatiya Nyaya Sanhita, 2023 subject to following conditions:
a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with one surety for the like sum to the satisfaction of the jurisdictional Court.
b) The petitioner shall not tamper the prosecution witnesses either directly or indirectly.

c) The petitioner shall attend the Trial Court on all dates of hearing, unless exempted and co- operate for speedy disposal of the case.
