THIS PETITION COMING ON FOR CONCILIATION BEFORE LOK ADALAT, THIS DAY, THE FOLLOWING ORDER IS PASSED:
CONCILIATION ORDER
The learned counsel for the petitioner and the learned counsel for the respondent along with parties are present. 2. The petitioner seeking issue a writ or order or direction writ in the nature of certiorari quashing the impugned award dated 5.9.2024 passed by the Labour Court, Raichur in Ref.No.1/2020 vide Annexure-B and pass such any other orders as deemed fit by this Hon’ble Court under the facts and circumstances of the case. 3. The joint memo reads as under: The writ petition filed against the award in Ref No.01/2020 dated 05-09-2024 on the file of District & Session Judge & Presiding Officer Labour Court at Raichur has been referred to this Lok Adalat by the Hon'ble High Court under Sec 20 of Legal Service Authority Act 1987. The parties to the appeal have settled their claim before Lok Adalat on the following terms. 3
"That the petitioner agreed to reinstate the respondent workman into service with continuity of service, without any back wages & consequential benefits from the date of dismissal to till date of actual reinstatement by withholding three ensuing increments with cumulative effect.”
The parties to this appeal have set their hands to this settlement before the Lok Adalat in the presence of conciliators on this day the 8th March of 2025 at Kalaburagi Bench. 5.
The Writ Petition stands disposed of in terms of the Joint Memo. The impugned award of the Labour Court shall stand modified accordingly. Draw up the award accordingly. Sd/- (C.M.JOSHI) JUDGE
