Heard the learned counsel appearing on either side and perused the materials available on record. 3. In pursuant to the complaint lodged by the 4th respondent, the 3rd respondent registered FIR in Crime No.341 of 2022 for the offence punishable under Section 406 and 420 of IPC as against the petitioner and his wife, alleging that the 4th respondent had paid substantial amount as an advance for the property owned by the petitioner and his wife, in order to 2/6 https://www.mhc.tn.gov.in/judis

However, the petitioner failed to execute any Sale Deed in favour of the 4th respondent and executed Sale Deed in favour of the third person and cheated the amount, which was received as an advance. After completion of investigation, the 3rd respondent also filed final report and the same is pending for taking cognizance on the file of the XVII Metropolitan Magistrate, Saidapet, Chennai. 4. The learned counsel appearing for the petitioner submits that while pending investigation, the 3rd respondent seized the original parent deed and handed over to the 4th respondent in respect of other properties.
In fact, during the mediation between the petitioner and the 4th respondent, the petitioner paid the substantial amount and even then, the 4th respondent failed to return the document. Therefore, the petitioner also filed a suit in O.S.No.2254 of 2025 on the file of the IV Additional City Civil Court, Chennai and it is pending for adjudication. He also submits that the petitioner though lodged several complaints as against the 4th respondent for doing Kandhu Vatti and claiming exorbitant interest, no action has been taken so far. 3/6 https://www.mhc.tn.gov.in/judis

5. In view of the above, the petitioner already filed a suit in O.S.No.2254 of 2025 on the file of the IV Additional City Civil Court, Chennai for return of document and it is pending. Further, no documents have been seized and produced before the Trial Court by the respondents 2 and 3 herein. 6. In view of the above, direction sought for by the petitioner in this writ petition cannot be granted. Accordingly, the Writ Petition (Criminal) is dismissed. However, the petitioner is at liberty to lodge a fresh complaint as against the 4th respondent for doing Kandhu Vatti and on receipt of the same, the 3rd respondent is directed to take appropriate action, if any cognizable offence is made out as against the 4th respondent.
