The petitioner through instant petition under Article 226/227 of the Constitution of India is seeking direction to respondent to reimburse medical expenses incurred by him. 2. The petitioner had retired as Sub-Inspector. In February’ 2024, he underwent coronary angiography and permanent pacemaker implantation at Post Graduate Institute of Medical Science and Research Chandigarh (in short “PGI”). He submitted medical bills of Rs.1,95,913/- with requisite documents. The respondent has approved bill of Rs.79,467/- and rejected claim of remaining amount. 3. Ms. Palika Monga, DAG, Haryana, supporting rejection of claim, submits that as per instructions dated 14.07.2020, the rate of every implant is pre-determined and respondent cannot pay over and above the MOHIT KUMAR 2025.07.18 18:14 I attest to the accuracy and integrity of this order/judgment. Mr. Umesh Narang, Advocate submits that respondent is relying upon instructions dated 14.07.2020 which are applicable in case of treatment from private empanelled hospitals/private empanelled medical colleges and the petitioner has received treatment from PGI Chandigarh. Thus, the said instructions are not applicable. 5. I have heard learned counsel for the parties and perused the record. 6. There is substance in the contention of the petitioner. The respondent has partially rejected claim of the petitioner relying upon the instructions dated 14.07.2020 which are applicable to private empanelled hospitals/private empanelled medical colleges. The petitioner has received treatment from PGI Chandigarh, thus, the aforesaid instructions are not applicable. 7. In the wake of aforesaid facts and findings, the instant petition is allowed and respondents are hereby directed to reconsider the claim of the petitioner in accordance with applicable policy. Let the needful be done within a period of four weeks from today.
