PUBLIC PROSECUTOR The Court made the following Order: The petitioners are arraigned as Accused Nos.1 and 2 in Crime No.15 of 2025, on the file of Pidiguralla Police Station, Palnadu District, for the alleged offences under Sections 191(2), 191 (3), 333, 118(1), 324(6), read with Section 190 of the Bharatiya Nyaya Sanhita, 2023 (for short ‘BNS’). 2. It is submitted by the learned counsel for the petitioners that they have right and title over the land admeasuring Ac.1.81 cents, while the respondent No.2 is claiming title over Ac.14.05 cents. 2 Disputes between the petitioners’ family and the 2nd respondent’s family relating to the said property are pending. 3. The learned counsel for the petitioners further submits that the respondent No.2 had filed W.P.No.24926 of 2020 against a third party, claiming that the respondents in the writ petition were trying to dispossess the petitioner from the land admeasuring Ac.14.05 cents. This court granted interim protection to the respondent No.2 vide order dated 19.12.2020. 4. The learned counsel for the petitioners further submits that the respondent No.2 has filed a complaint alleging that the petitioner No.1, along with 30 others, came to the 2nd respondent’s house on 14.01.2025 at about 1:30 AM and demolished the shed with the help of a JCB. It is also alleged that the petitioners and others manhandled and beat up the respondent No.2. Based on these allegations, the respondent No.2 filed a complaint and the police have registered a case. 5. Considering the disputes between the petitioners and the respondent No.2, the police are directed to follow the procedure as contemplated under Section 35 (3) of the Bhartiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’). 3 6. With these observations, the criminal petition is disposed off.
