Sri Kaustub Jagirdar, learned counsel for the petitioner. 2. Though the matter is listed for compliance on I.A. No.6/2025 to I.A. No.33/2025, which are all filed for bringing the legal representatives of some of the deceased respondents on record and few other applications. - 6 - HC-KAR NC: 2025:KHC:53556 CP No. 193 of 2023 3. Taking note of the prayer in the affidavits, this Court felt that issue of notice to the proposed legal representatives are unnecessary and therefore the matter is taken up for final disposal. 4. Present Civil petition is filed under Section 24 of the Code of Civil Procedure with the following prayer: “WHEREFORE, the Petitioner prays that this Hon'ble Court may be pleased to call for the records in O.S. No. 2952 of 2018 is a suit filed by the Petitioner before the Learned VII Additional City Civil and Sessions Judge (CCH-19), Bengaluru Urban at Bengaluru and transfer the same before the Senior Civil Judge and JMFC at Anekal and grant such other or further relief / reliefs as this Hon'ble Court may deem fit in the circumstances of the case.” 5. It is contented in the petition that in O.S. No.2952/2018 is filed on the file of Additional City Civil Judge, Bangalore (CCH-19) and five other cases are filed on the file of the Civil Judge (Senior Division), Anekal, between the same parties in respect of the same subject matter of the suit. - 7 - HC-KAR NC: 2025:KHC:53556 CP No. 193 of 2023 6. On perusal of the petition averments, it is noted that petitioner is aged 70 years and he is unable to attend the Court at Bangalore effectively on all dates of hearing on account of his ill-health and geographical distance. 7. Matter is pending from the year 2023 and because of the pendency of the Civil Petition, all the six suits are not proceeded with. 8. It is noted that geographical distance and ill- health and such other similar reasons that are assigned for seeking transfer of the pending suit from City Civil Court, Bangalore to Anekal are no longer valid parameters to transfer pending cases from one court to another in view of the fact that the petitioner can effectively participate in the suit in O.S.No.2952/2018 through video conferencing facility. 9. Sri. Jagirdar would submit that petitioner is not technically sound enough and may not have the necessary infrastructure to appear through video conferencing. - 8 - HC-KAR NC: 2025:KHC:53556 CP No. 193 of 2023 10. To quell such an apprehension, it is made clear that the petitioner can avail the services in the E-Seva Kendra established in Anekal Court and with the assistance of the System Assistant, he can effectively appear before the Bangalore Court through video conferencing in O.S. No.2952/2018 on all dates of hearing including the recording of evidence. 11. If such an application is filed by the petitioner in O.S.No.2952/2018, learned Additional City Civil Judge, Bangalore shall permit the petitioner to appear through video conferencing by providing necessary assistance. 12.
