1. This petition has been filed with a prayer to quash the notification dated 14.08.2024 (Annexure P-6), whereby, pension of Rs.20,000/- has been fixed for the residents of Haryana with effect from 01.07.2024, who remained in jail during emergency period.
2. The only ground of challenge to the notification is that some of the other states have fixed higher rates of pension.
3. The notification issued by the State Government merely intends to ameliorate the condition of those who have suffered on account of violation of their fundamental rights during emergency imposed from 25.06.1975 to 21.03.1977. The pension to the extent of Rs.20,000/- has been allowed to the residents of Haryana, who have suffered on account of such emergency. The issuance of notification is on the premise that the fundamental rights of the residents were infringed in the process. 4. In what manner the State intends to compensate those who have been wronged during emergency would be an aspect of policy to be determined by the State itself. Merely because in some states, a higher amount towards pension has been fixed, cannot be a ground for this Court to interfere with the notification or to direct the authorities to pay higher amount as pension to the residents of the Haryana .
5. The present petition is hereby dismissed.
