ORAL ORDER Heard the learned counsel for petitioner, learned High Court Government Pleader for the State and perused the material on record.
2. Petitioner is seeking bail in Crime No.268/2016 registered at Parappana Agrahara Police Station, Bengaluru City for the offence punishable under Section 399 and 402 of IPC.
3. FIR is registered against accused Nos.1 to 6 on a suo motto complaint lodged by PSI of parappana Agrahara Police Station. It is alleged that the accused were making preparation to commit dacoity near the cemetery, Doddanagamangala Village at about 10.00 p.m., on 07.07.2016 and on receiving the said information the police along with panchas went to the spot and

apprehended accused Nos.1 to 5 and one of the accused managed to escape. From the arrested accused, wooden club, chilli powder packets, mobile phones etc., were seized.
4. Petitioner/accused No.5 who was arrested from the spot, was granted bail during crime stage. After committal of the case, since he was irregular to the Court, warrants were issued and pursuant to the warrant, he was arrested and in custody from 15.03.2025.

The learned counsel for petitioner contended that the petitioner was regularly attending the trial, however, he was arrested and remanded to judicial custody in connection with another case registered in C.C.No.26190/2017 and therefore, he could not appear before the trial Court in the present case. He submits that the petitioner is ready and willing to abide by conditions and will offer sufficient surety to ensure his regular

presence. Accordingly, sought to allow the petition and enlarge the petitioner on bail.

Learned High Court Government Pleader contended that the petitioner has been irregular before the trial Court and on several occasion warrants are issued and even after the warrants are recalled, he once again remained absent and therefore, the learned Sessions Judge has rightly rejected his bail petition. He submits that the petitioner is a habitual offender involved in two more cases and therefore, if he is released on bail, he may once again commit similar offences and also flee from justice.
7. It is not in dispute that the petitioner was initially granted bail in this case. The submission of the
learned counsel is that the petitioner was arrested in connection with C.C.No.26190/2017, wherein he is arraigned as accused No.3 and as he was in judicial

custody in the said case, he could not appear before the trial Court in the present case.
8. The material on record would reveal that after the petitioner was released on bail he remained absent before the trial Court on several occasions and therefore, NBWs were issued against him. Inspite of recalling of the NBW, he remained absent and therefore, he is not regular in attending the trial proceedings. However, considering the fact that petitioner is in custody from 15.03.2025, an opportunity can be given to him. Hence, his prayer seeking bail can be considered by imposing stringent conditions. Accordingly, the following:
ORDER (i) Petition is allowed.
(ii) Petitioner/accused No.5 in Crime No.268/2016 of Parappana Agrahara Police Station pending in S.C.No.753/2017 on the file of the Court of LXI Additional

City Civil and Sessions Judge, Bengaluru, shall be released on bail, subject to following conditions:
1. He shall execute a personal bond in a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for the likesum to the satisfaction of the jurisdictional Court.
2. He shall furnish proof of his residential address and shall inform the Court, if there is change in the address.
3. He shall not directly or indirectly tamper with the prosecution witnesses.
4. He shall mark his attendance before Parappana Agrahara Police Station on 1st and 15th of every month between 9.00 a.m., and 1.00 p.m. for a period of 6 months or till conclusion of trial, whichever is earlier.
5. He shall not indulge himself in committing any offence.

6. He shall appear before the trial Court on every date of hearing without fail.
Violation of any of the above condition shall result in cancellation of bail.
