The petitioners, by means of the present writ petition, have assailed the order dated 25.06.2025 passed by the District Magistrate, Sonbhadra. 3. Shri Rajeshwar Tripathi, learned Additional Chief Standing Counsel, has raised a preliminary objection about the maintainability of the writ petition on the ground that a statutory remedy of appeal is available to the petitioners under Rule 79 of the U.P. Mines and Minerals (Concession) Rules, 2021. 4. Since the aforesaid submission of the learned Additional Chief Standing Counsel is not disputed by learned counsel for the petitioners, the writ petition is dismissed on the ground of availability of an alternative remedy. 5. However, it is provided that in case the petitioners prefer an appeal before the appellate authority within a period of one month from today, the said authority shall consider and decide the same on merits, without entering into the question of limitation.
