This special appeal arises out of an order passed by learned Single Judge dated 30.7.2024, whereby the writ petition itself has been dismissed. Learned Single Judge has recorded that appointment of petitioner appellant was in Janta Primary School, Bansthan, District Azamgarh, which is run by private management and no procedure known to law was followed before appointing the appellant. Learned Single Judge for such reasons has denied grant of any relief to the appellant. We have perused the records of writ, which shows that appointment letter was issued to the appellant by the Manager on 12.8.2014. Neither any procedure is shown to have been followed before such appointment was made nor the appointment of petitioner was ever approved. The engagement of petitioner appellant is not shown to be governed by any statutory service rules and the obligation of the State to pay salary is also not shown to arise at the time when the appointment itself was made. The institution has been brought on the list of aided institution in the year 2020. Claim of petitioner has not been considered because her appointment was neither found to have been approved by any authority nor any procedure was shown to have been followed. The submission of learned counsel for the appellant that the manner of recruitment or the lack of approval was not the issue cannot be countenanced, inasmuch as before any obligation could be imposed upon the State, it would have to be shown as to whether the appellant's appointment was a valid appointment on account of which the State was obliged to pay salary.
