HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - A No. - 14133 of 2025 Court No. - 4 HON'BLE AJIT KUMAR, J. Heard Sri Santosh Shukla, learned Advocate holding brief of Sri Abhinav Mishra, learned counsel for the petitioner as well as Sri Rahul Malviya, learned Standing Counsel. By means of this petition filed under Article 226 of the Constitution, petitioner has prayed for a writ in the nature of mandamus to command the respondents authorities to regularize the services of the petitioner on the post of Collection Ameen and pay him regular salary month by month since April
1997. Admittedly therefore, the petitioner has not been paid salary since 1997 and has now approached this Court after a lapse of more than 18 years. Sri Rahul Malviya, learned Standing Counsel submits that petitioner has not annexed any document which may demonstrate that petitioner has been engaged continuously as Seasonal Collection Ameen and hence it is to be presumed that petitioner had been disengaged in 1997 and therefore, the petition is barred by limitation for delay and laches. Upon a pointed query being made, learned counsel for the petitioner could not demonstrate from any of the documents brought on record that the petitioner has continued to discharge duty since 1997, instead the document that has been brought on record shows that petitioner discharged duties from 19.01.1992 to 15.08.1993. In view of the above, petitioner is definitely guilty for delay and laches, inasmuch as, now after 18 years he can not be directed to be engaged when he failed to continue since 1997 as per his own averments and virtually Versus Counsel for Petitioner(s) : Abhinav Mishra Counsel for Respondent(s) : C.S.C. Ram Naresh .....Petitioner(s) State Of U.P. And 3 Others .....Respondent(s)
abandoned his claim. In view of the above, petition is dismissed, both for delay and laches and also on merits.
