This petition is filed by the accused/petitioner seeking quashing of the proceedings pending in C.C.No.3877/2023 for the offences punishable under Section 420 of IPC and Sections 66(C), 66(D) of Information Technology Act, 2000.
2. Today, a joint memorandum has been filed under Section 320 read with Section 482 of the Code of Criminal Procedure, 1973. Respondent No.2, the defacto complainant, is present before this Court. She submits that the dispute arose from a purely monetary transaction and acknowledges that the petitioner/accused has already returned a sum of Rs.1,10,000/-. She further affirms that the settlement is entirely amicable, arrived at voluntarily, and without any pressure or coercion. She expressly states that she has no objection to quash the proceedings and has agreed to withdraw the allegations made against the petitioner/accused.
3. Upon perusal of the joint memorandum and the materials filed along with the petition, it is evident that the dispute is essentially civil in nature. Considering that the petitioner/accused has returned the money and that the

HC-KAR NC: 2025:KHC:31933 CRL.P No. 10572 of 2025 offences are compoundable, this Court is of the view that, to prevent abuse of the process of law, the parties may be permitted to compound the offences punishable under Section 420 of the Indian Penal Code, 1860, and Sections 66(C) and 66(D) of the Information Technology Act, 2000.

In view of the amicable settlement reflected in the joint memorandum, and having regard to the fact that the petitioner/accused has already restituted the amount in question, the proceedings are liable to be quashed. Accordingly, the parties are permitted to compound the offences in terms of the joint memorandum.
5. Consequently, the proceedings pending in C.C.No.3877/2023 on the file of the XLV Additional Chief Judicial Magistrate, Bengaluru, are hereby quashed, and the Criminal Petition is allowed. Sd/- (SACHIN SHANKAR MAGADUM) JUDGE SMJ List No.: 1 Sl No.: 45
