HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - C No. - 32328 of 2025 Court No. - 6 HON'BLE PRAKASH PADIA, J. 1. The proceedings were initiated by the petitioner who is a workmen before the Presiding Officer Labour Court No. 2, Ghaziabad/respondent no. 2 which was numbered as Adjudication Case No. 35 of 2017. In the said proceedings an ex-parte award was made in his favour on 19.02.2024. Aggrieved against the aforesaid the employer/respondent no. 3 moved a recall application which was allowed vide order dated 17.05.2025. The aforesaid recall was allowed by imposing a cost of Rs. 20,000/-. 2. Though various arguments were made by the counsel for the petitioner in support of the present writ petition but ultimately a prayer has been made that the respondent no. 2 before whom the proceedings of the aforesaid matter is going on is directed to decide the matter on merits expeditiously. 3. This prayer has not been opposed by Sri Vivek Kumar Yadav, learned counsel appearing on behalf of respondent no. 3 as well as learned Standing Counsel appearing on behalf of State-respondent. 4. Heard counsel for the parties and perused the record. 5. In view of the facts and circumstances of the case, the present petition finally disposed of directing the respondent no. 2/Presiding Officer Labour Court No. 2, Ghaziabad to decide the Adjudication Case No. 35 of 2017 strictly in accordance with law most expeditiously and preferably within a period of four months from the date of production of certified copy of this order before him.
