Heard learned counsel for the petitioner, Mr. Shashi Prakash Singh, learned counsel for respondent-B.S.A. as well as learned Standing Counsel for the State. The present petition has been filed with the prayer to direct the respondent no.2 decide the application/representation of the petitioner with regard to her transfer from District- Azamgarh to District- Varanasi, within stipulated period. Learned counsel for the petitioner submits that the petitioner is a permanent resident of Village and Post Kuiriyapar, District- Mau and is working as Assistant Teacher in Primary School Sathiyaon First, Block- Sathiyaon, District- Azamgarh with utmost sincerity and dedication. He further submits that the petitioner has moved an application/representation before the authorities concerned requesting for her transfer, mentioning the hardships she is facing as she is not able to manage all alone since she is having minor children aged 5 years and 3.5 years respectively. The petitioner's husband is employed in Uttar Pradesh Police (Civil) and is currently posted at Varanasi. He further submits that the petitioner's mother-in-law, being an old lady is suffering from numerous old age ailments and is presently undergoing treatment at Varanasi, therefore, her application/representation requesting for transfer from District- Azamgarh to District- Varanasi may be considered, at the earliest. Learned counsel for respondent-B.S.A. submits that the application for Versus Counsel for Petitioner(s) : Man Bahadur Singh, Manoj Kumar Singh Counsel for Respondent(s) : C.S.C., Shashi Prakash Singh Reena Yadav .....Petitioner(s) State Of U.P. And 2 Others .....Respondent(s) transfer can be considered only when the online application for transfer is moved. He further contends that in case, in future, another online application requesting for transfer is moved, the same shall be considered, in accordance with law. Considering the facts of the case, without expressing any opinion on the merits of the case, the writ petition is finally dispose of with a direction that when ever an online transfer application is moved by the petitioner, the same shall be considered and decided by the authorities concerned, sympathetically, in accordance with law, by means of reasoned and speaking order, after giving opportunity of hearing to the petitioner, as expeditiously as possible, if there is no other legal impediment.
