On oral prayer made by counsel for the petitioner, he is permitted to implead Hasim s/o Musha as respondent no. 8 to the writ petition. 2. The following prayer has been made in the instant writ petition: "(i) a writ in the nature of mandamus commanding to the respondent Nos. 01 to 04, to remove the illegal construction of house situated between the pitch road and chak/gata No. 245Mi/0.034 Kari of the petitioner, situated in Village Chandpar, Paragrana and Tehsil Sagari, District Azamgarh within specific period, as well as punish the same for the illegal action." 3. The case of the petitioner is that in between his Chak bearing Gata No. 245M and public road, the private respondents have raised constructions, which, according to petitioner, are illegal and an encroachment. The petitioner has, therefore, prayed for a direction to State - respondents to ensure removal of the building constructed by private respondents from the said part of the land. 4. There is a communication of Executive Engineer, Provincial Division, PWD, Azamgarh addressed to S.D.M. Sagari, Azamgarh requesting him to ensure correction of the consolidation map and other revenue records to show existence of public road constructed over the acquired land. It is not clear from any material on record of the instant petition that the constructions of private respondents are encroachment over any part of the public land or road. 6. As such, we refrain from examining the issue in exercise of writ jurisdiction. We leave it open to the petitioner to approach respondent no. 3 for redressal of his grievance, if so advised, or avail such other remedy, as may be available to him under law. 7.
