The present appeal under Section 14A(2) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 (in short ‘SC/ST Act’) has been filed against the impugned order dated 05-02-2025 passed by the learned Special Judge, SC/ST Act, Mahasamund, in Special Case No.13 of 2024, whereby, application filed under Section 483 of the Bharatiya Nagrik Suraksha Sanhita, 2023 (BNSS) in connection with in Crime No.92 of 2024 registered at Police Station- Komakhan, Distt.-Mahasamund, (C.G.) has been rejected. 2. Learned counsel for the appellant would submit that earlier the appellant filed an appeal, i.e., CRA No.1813 of 2024 which has been dismissed vide order dated 20-12-2024 by this Court and since the earlier dismissal of the criminal appeal filed by the appellant was not in knowledge of father of the appellant, by mistake he has Digitally signed by MOHAMMAD AADIL KHAN 2 filed the present appeal and could not disclose the dismissal of the earlier appeal of the appellant. 3. Learned counsel for the appellant for the aforesaid reason prays for withdrawal of the present criminal appeal with liberty to file it afresh after disclosing the correct fact. 4.
