The petitioner has been made accused in connection with Chhattarpur P.S. Case No. 72 of 2024, corresponding to G.R. Case No.1080 of 2024, S.T. Case No.430 of 2024, for the offence registered under Sections 324, 326 & 307/34 of the Indian Penal Code and Section 27 of the Arms Act, further charge has been framed under Sections 302/34 I.P.C and Section 27 of the Arms Act, pending in the court of Sri Prateek Chaturvedi, learned A.S.J.-VII, Palamau at Daltonganj. Bail application of the petitioner was earlier rejected by this Court in B.A. No. 8945/2024, vide order dated 17.10.2024. On 29.04.2024, the father of the informant namely Santosh Prasad was shot by the petitioner near Chhattarpur Girls School. The father of the informant died during the course of treatment. From perusal of the written report, it is evident that the deceased had specifically stated that petitioner had shot him. Learned counsel for the petitioner has drawn attention towards the statement of P.W.3, who was the brother of the deceased and was present at the place of occurrence, who in his cross -examination it was stated that he saw the deceased lying at the place of occurrence in unconscious state and he was unable to speak anything. -2- It will not be proper to analyze the statement of the witness and it will prejudice the prosecution case. Considering the nature of allegation, I am not inclined to release the petitioner, on bail. Accordingly, the prayer for bail of the petitioner is hereby rejected. Learned Trial Court shall expedite the trial. (Ambuj Nath, J.) BS/-
